The Court (Sykes/Hamilton/St. Eve, per curiam) reversed SJ against a prisoner for a failure to exhaust. The BOP requires grievances to be filed on a particular form, and Gooch’s requests to prison staff for the form were rejected. The Court held that this rendered administrative remedies unavailable, even though the plaintiff could have tried other methods to get the form. Slip Op. at 6. The Court also holds that the plaintiff’s evidence that guards threatened him if he complained provided an independent reason that the remedies weren’t available.
