Dispute Resolution
Arbitration & Mediation
Since his retirement from the federal bench, Judge Tinder has assisted parties and counsel resolve litigation disputes outside of court. Kaplan & Grady provides skilled legal and logistical support for Tinder, allowing him to work on matters of any size and complexity.
With twenty years of experience as a federal trial court judge, eight as a federal appellate judge, and three as the United States Attorney for his district, Tinder brings a rare perspective to dispute resolution. He is equally adept at addressing factual and evidentiary issues as he is adjudicating the central legal questions that turn a case.
Tinder has a reputation among litigants and judges alike for his intelligence, independence, even-handedness, and work ethic. As he did while on the bench, he gives each case the individual attention it requires, fully engaging with counsel to understand their clients’ positions and priorities. He draws on his experience—and the broad credibility it brings—to efficiently remove obstacles to settlement.
Arbitration and mediation are meant to be cost-effective ways to resolve disputes privately and efficiently. In keeping with that laudable purpose, Tinder takes his cues on procedure from the parties. He will arbitrate or mediate under the rules selected by counsel. To the extent that there is not agreement on rules, Judge Tinder will propose a method suited to the case and parties.
In addition to working with both sides toward settlement, Tinder is often engaged to provide counsel with candid feedback and advice on trial or appellate presentations.
