Ross v. Gossett
No. 20-1992, 2022 WL 2500420 (7th Cir. July 6, 2022)

The Court (Manion/Rovner/St. Eve, with Rovner writing) affirmed a grant of a Rule 23(b)(3) class action better known as the “Orange Crush” case. The opinion is helpful for those with class claims, clarifying that Wal-Mart doesn’t require a quantum of proof at the class cert phase–it requires that the proof offered be cohesive rather than individualized.
